Terms of Service

PLEASE READ CAREFULLY. By creating an account, accepting these Terms when prompted, or using an account after receiving reasonable notice of these Terms, you agree to them. If you use GetDotFlow for a business, you represent that you are authorized to accept these Terms on that business's behalf. If you do not agree, do not use the service. A person who merely visits a public page or receives a client portal link is not automatically agreeing to every provision of these business account Terms.

2. The Service and License

Subject to these Terms and any applicable written subscription agreement, GetDotFlow grants the Tenant a limited, non-exclusive, non-transferable right to access and use the Service for its internal business operations during its authorized subscription.

The Tenant may permit its authorized Users to use the Service on its behalf. The Tenant is responsible for assigning appropriate access and for its Users' compliance with these Terms.

GetDotFlow may update, maintain, or change Service features over time. We will use reasonable efforts to give notice when a material change substantially affects a paid Tenant's use of the Service.

The Tenant must have the rights and authority needed to enter Tenant Content, send communications, and share reports or portal links through the Service.

4. Inspections and Regulatory Responsibilities

GetDotFlow provides tools to create, organize, store, and share inspection-related records. It does not perform a physical inspection, qualify an inspector, certify a vehicle, or guarantee compliance with 49 CFR Part 396 or any other law.

The Tenant and the responsible inspector or motor carrier must determine which rules apply to their work and are responsible for:

A reminder is a convenience feature. The Tenant remains responsible for tracking deadlines even if an email is delayed, blocked, misaddressed, or not delivered. Nothing in these Terms transfers a Tenant's regulatory obligations to GetDotFlow.

5. Tenant Content and Privacy

The Tenant retains its rights in Tenant Content, subject to the rights of other owners or individuals represented in that content. The Tenant grants GetDotFlow the limited rights needed to host, process, back up, display, transmit, and otherwise handle Tenant Content to provide, secure, maintain, and support the Service as described in our Privacy Policy.

The Tenant decides what information its Users enter, who may access it through the Tenant account, and which Clients receive emails, reports, or links. The Tenant is responsible for providing required notices and obtaining any legally required permissions for those actions.

Our collection, use, disclosure, and retention practices are described in the GetDotFlow Privacy Policy.

6. Accounts and Security

Tenants and Users must provide accurate account information, protect their login credentials, and promptly tell us at [email protected] if they suspect unauthorized access.

The Tenant is responsible for activity by its authorized Users. The Tenant is not automatically responsible for unauthorized activity caused solely by GetDotFlow's own failure to protect the Service; responsibility for a specific incident will depend on the facts and applicable law.

7. Emails, Reports, and Shared Links

The Tenant is responsible for the accuracy of recipient addresses and for its decision to send reminders, reports, or other communications. The Tenant must comply with applicable rules governing the messages it sends, including rules for promotional email where relevant.

A Client Portal or report link may permit anyone possessing a working link to view the information made available through it. The Tenant must share links carefully and manage any available expiration or revocation settings. GetDotFlow cannot recall copies of records that recipients have already downloaded or saved.

GetDotFlow does not guarantee that an email will arrive by a particular time or that a recipient will read it.

8. Fees, Trials, and Cancellation

Fees, billing dates, included features, and any trial terms are those presented to the Tenant at signup or stated in a separate written agreement. If a separate written agreement conflicts with this section on pricing or billing, that agreement controls those matters.

For a recurring subscription, we will provide at least 30 days' notice before increasing the price for an existing paid Tenant. A new price will apply no earlier than the next billing period after that notice, unless the Tenant expressly agrees otherwise.

A Tenant may request cancellation by emailing [email protected]. Cancellation stops future recurring charges after the effective cancellation date, subject to the Tenant's written billing agreement. Fees already paid are non-refundable except where required by law or expressly provided in a written agreement. We will not charge an unstated cancellation fee.

If a payment is overdue, we may give notice and a reasonable opportunity to resolve the issue before suspending access, except where continued access presents a security or legal risk.

9. Availability and Warranties

We work to keep the Service available and functioning, but maintenance, technical failures, third-party services, and other events may interrupt access. Unless a separate written agreement provides a specific service commitment, GetDotFlow does not promise uninterrupted or error-free operation.

To the extent permitted by applicable law, the Service is provided "as is" and "as available," and we disclaim implied warranties that may lawfully be disclaimed. This section does not limit any rights that cannot be waived under applicable law.

10. Limits on Liability

To the maximum extent permitted by applicable law, neither party will be liable to the other for indirect, incidental, special, consequential, or punitive damages arising from the Service, including lost profits or lost business opportunities, even if advised that such damages were possible.

To the maximum extent permitted by applicable law, GetDotFlow's total liability for claims arising from or relating to the Service will not exceed the fees the Tenant paid to GetDotFlow for the Service during the three months immediately before the event giving rise to the claim.

These limitations do not apply where prohibited by law and do not excuse fraud, willful misconduct, or other liability that applicable law does not permit a party to exclude or limit. Nothing in this section removes GetDotFlow's responsibility for its own conduct merely because a hosting or other service provider was involved.

11. Suspension and Termination

A Tenant may request termination at any time by emailing [email protected], subject to any applicable written subscription agreement.

We may suspend access when reasonably necessary to address a security threat, unlawful use, a material violation of these Terms, or an overdue payment. Where practicable, we will notify the Tenant and provide an opportunity to resolve the issue. We may act immediately when delay would create a material risk to the Service, other users, or third parties.

We may terminate an account for a material breach that is not resolved after notice and a reasonable opportunity to cure, or immediately when the violation cannot reasonably be cured or continued access would be unlawful or materially unsafe.

Before planned termination, Tenants should export records they need to retain. Following termination, access and deletion are handled as described in the Privacy Policy and any applicable written agreement. Sections that by their nature should survive termination, including payment obligations accrued before termination, intellectual property, limitations of liability, and dispute provisions, will survive.

12. Intellectual Property

GetDotFlow and its software, design, interfaces, and documentation belong to Islomjon Qurbonov or the applicable rights holder. These Terms grant access to the Service, not ownership of it.

A Tenant's rights in Tenant Content are addressed in Section 5. Nothing in these Terms transfers ownership of a Client's information or another party's documents to the Tenant or GetDotFlow.

13. Changes to These Terms

We may update these Terms as the Service changes. We will post an updated version showing its effective date. For material changes affecting existing Tenants, we will provide reasonable advance notice by email, in the application, or both, unless a change is needed sooner to address a legal or security issue.

If the Tenant does not agree to materially changed Terms, it may stop using the Service and request cancellation before the changes take effect. Where additional consent is required by law, we will seek it. A change will not retroactively authorize a materially different use of previously collected personal information merely because revised Terms have been posted.

14. Governing Law and Disputes

New Jersey law governs these Terms, without regard to its conflict-of-law rules, except where another applicable law cannot be excluded.

Before filing a lawsuit, the parties will make a good-faith effort to resolve a dispute by sending a written description of the issue to the other party and allowing 30 days for a response, unless urgent court relief is reasonably necessary.

Subject to applicable law, disputes arising from these Terms or the Service may be brought in the state or federal courts located in New Jersey, and each party consents to the jurisdiction of those courts. These Terms do not require arbitration.

15. General Terms

If a provision of these Terms is unenforceable, the remaining provisions remain in effect to the extent permitted by law. A party's failure to enforce a provision on one occasion does not waive the right to enforce it later.

These Terms, the Privacy Policy, and any applicable written subscription agreement describe the relationship concerning the Service. If a written subscription agreement conflicts with these Terms, that agreement controls to the extent of the conflict for the parties to that agreement.
